Board opts into Navitus class-action recovery service; county to pay 25% fee from any proceeds

Black Hawk County agreed April 29 to opt into a statement of work with Navitus Health Solutions LLC and the county’s pharmacy benefit manager to pursue recovery of prescription-related class-action settlement proceeds on behalf of the county’s health plan.
County benefits staff and the county’s consultant described the arrangement as a contingency-based recovery service: Navitus will pull and clean claims data and pursue eligible settlements, and the county will pay a 25% fee of any settlement proceeds recovered; that fee will be deducted from settlement funds before deposit to the county. Staff said there is no upfront charge and no payment unless and until recoveries are obtained.
Why it matters: staff said individual counties often lack scale and data-resources to pursue complex class-action settlements on their own; by contracting with Navitus the county gains access to the vendor’s data work and recovery process at a contingency rate. The board approved the statement of work by roll call.
