The Madison Plan Commission unanimously approved an alteration to the specific implementation plan and related conditional uses on Monday to allow amplified outdoor sound and a restaurant/nightclub use at 8216 Watts Road, subject to conditions that limit hours and frequency.
Planning staff said the 2018 plan text for the property had expressly prohibited amplified outdoor sound and limited outdoor seating; the applicant proposed removing that prohibition and making amplified sound a conditional use. Staff recommended approval subject to conditions including ending amplified sound at 9 p.m., limiting amplified outdoor events to two per week, and retaining Planning Commission jurisdiction to act on complaints.
Chris (Planning Division) told commissioners the outdoor area under consideration is roughly 375 square feet and sits about 160 feet from the nearest residential units. Staff concluded that, with the recommended conditions and because the outdoor area is separated from residences by a parking lot, the conditional-use standards could be met. "Given due consideration of adopted plans, staff believes that the conditional use approval standards can be found met subject to the recommended conditions of approval," Chris said.
Tim Mulca (applicant representative for Brennan's Market / applicant operator) said the business intends to add music as part of patio ambiance and did not intend frequent or loud weekend-night concerts. He told the commission he envisioned amplified sound primarily Thursday through Sunday evenings and said he would avoid amplified sound during typical daytime hours. "Monday through Friday would certainly be acceptable" to limit amplified sound until after 5 p.m., he told the commission in response to a commissioner question.
Commissioners and registrants discussed neighborhood engagement and proximity to apartment units. Alder Pritchett and Alder Harrington-McKinney urged the applicant to re-engage area residents and to consider programming that would be appropriate for nearby senior residents and other neighbors. Tim said he had communicated with his alder and with customers but acknowledged wider outreach might be helpful.
Alder Ugar moved to approve the zoning-text alteration and the conditional uses for a restaurant/nightclub and for amplified outdoor sound, subject to the conditions recommended by staff and an additional condition that amplified sound would not be used Monday–Friday before 5 p.m.; Alder Glen seconded. The motion included staff's other recommended limits: amplified sound must end at 9 p.m., amplified outdoor events should be limited to two per week, and after six months staff may consider an administrative minor alteration to increase the number of weekly events. Commissioner Sanders clarified that the Monday–Friday restriction would allow amplified sound to begin at 5 p.m. and end at 9 p.m.; that timing is reflected in the adopted conditions. The commission recorded the vote as unanimous.
The approval is conditioned on the applicant adhering to the times and frequency limits and other standard conditions listed in the staff report; because the Planning Commission retains continuing jurisdiction, neighbors may raise complaints later and the commission can revisit the conditional use if problems arise.
