Board approves district fiber agreement but stalls planned cabling and hardware upgrades after split vote

SPRINGFORD, Pa. — The Spring-Ford Area School District board on April 28 approved a Category 1 E-rate agreement to secure fiber connectivity linking district buildings but failed to approve accompanying cabling and hardware upgrades after a 4–4 tie.

Board members separated the items for voting after questions about whether the district would receive federal E-rate reimbursement if courts change program rules. The Category 1 agreement, which funds connectivity (dark fiber and leases to provide internet service to district buildings), passed 6–2. A subsequent vote on Category 2/3 cabling and hardware upgrades, which were presented as scheduled annual upgrades, ended in a 4–4 tie and therefore failed.

Dr. Hill, who handled technical questions for the district, explained that Category 1 provides the backbone — fiber that connects buildings — while the Category 2/3 items are planned cabling and hardware upgrades that would be done in coordination so warranties and support align. The board discussed the timing risk because a national court case concerning E-rate and similar federal programs is pending; members asked whether reimbursement could be clawed back if a court decision undercuts the program.

District counsel and staff responded that a court decision is expected in late spring or early summer and that they did not anticipate clawbacks for costs already incurred prior to a decision, though no guarantee was certain. Several board members said they would not vote for the C2/C3 work until there was more clarity on whether the district would receive the expected 50% E-rate reimbursement; other members said delaying the cabling work could reduce potential cost savings and affect warranties.

The failed vote means the cabling/hardware upgrades will not proceed as presented and could be returned to the board at a later date if staff can provide additional information about timing, reimbursement risk and warranty alignment. The board recorded the Category 1 approval as a separate item so that connectivity work could move forward if staff and administration decide that is appropriate.

Board members said the items were discussed in the curriculum and finance context, with particular reference to the eighth-grade building where some of the cabling work was to occur. Staff said the cabling work was part of the district’s annual upgrade plan and would have been scheduled to align warranties and support agreements.
