Plan Commission places Minakwa Brewing amplified-sound request on file after neighbors, staff flag proximity to homes

The Madison Plan Commission on Monday placed on file without prejudice a conditional-use request to allow amplified outdoor sound at the taproom located at 2927 East Washington Avenue, citing the site's close proximity to homes and a prior building inspection enforcement notice.
Planning staff told the commission the applicant seeks permission for amplified sound in an existing roughly 1,100-square-foot outdoor area but would not extend hours past the current 9 p.m. closing requirement. Staff recommended the application be placed on file, saying the request failed to meet conditional-use standard No. 3, which requires that “the uses, values and enjoyment of other property in the neighborhood… will not be substantially impaired or diminished.”
Chris (Planning Division) told the commission that of 78 recent outdoor-seating requests citywide, only eight had been approved for amplified outdoor sound and that the median distance to nearby residences in those approvals was 143 feet. He said sites with 40 feet or less of separation — the situation at 2927 East Washington — had produced 26 proposals and only one approval. Staff noted the taproom's outdoor area directly abuts residential property and is roughly 40 feet from the nearest dwelling. Staff also said the property received a building-inspection enforcement notice in October 2024 regarding amplified sound and hours-of-operation and recommended placing the request on file without prejudice.
Kirk Bankshead, the taproom operator at 2927 East Washington Avenue, addressed the commission in support of the request and invoked the taproom's role as a community arts venue. "Amplified music at 90 decibels are barely louder than the street traffic on East Washington," Bankshead said, adding that the venue would not necessarily use the full hours requested and that he intended to monitor sound. Several registrants — including Nick Pivak, chair of the City of Madison Arts Commission, and neighbors — spoke during the public hearing. Pivak urged the commission to balance arts and neighborhood impacts and pointed to prior local debates about outdoor music. Alex Sherwood, a neighbor who lives adjacent to the beer garden, said the site's layout funnels sound into nearby living spaces and asked the commission to follow staff's recommendation. "That cinder block building... manages to reflect and funnel, like, clear conversations right into our kitchen and bedroom," Sherwood said.
Matt Tucker, director of the Building Inspection Division, explained the office's enforcement approach and said its priority is to achieve compliance: "Our first and foremost effort... is to help folks gain compliance." He described the October 2024 notice as an official reminder that outdoor amplified sound and operations past 9 p.m. were not permitted under the property's then-current approvals; staff said they were not aware of subsequent citations.
Commissioner Solheim moved that the commission find the conditional-use standards not met and place the request on file without prejudice, citing standard No. 3 and the prior building-inspection notice; Alderfield seconded. The motion passed unanimously. The commission recorded the action as placement on file without prejudice, which requires findings of fact identifying the standards not met and the reasons.
Because the commission placed the request on file without prejudice rather than denying it outright, the applicant may revise and refile. Staff had also recommended, if the commission had chosen to approve, conditions such as a one-year trial period and additional mitigation measures; these were not adopted because the application was placed on file.
