Maitland council adopts nonexclusive franchise for construction and demolition hauling

The City of Maitland City Council on April 28 adopted Ordinance No. 1422, granting Earth Hall LLC a nonexclusive franchise to provide construction and demolition debris hauling within the city.
Council members said the move follows an existing approach in which the city maintains a separate, optional franchise process for construction-and-demolition (C&D) hauling rather than requiring residents and contractors to use the municipality's primary hauler. City Manager Mark (last name not specified) said the change preserves flexibility for contractors and homeowners to shop among providers for C&D hauling services while the city's commercial/residential franchise with Waste Pro remains in place.
"Back in 02/2013, city council approved an exclusive franchise agreement with Waste Pro, who does all of our commercial and residential recycling and waste hauling," Mark said. "One part of that agreement was left out was construction and demolition debris pickup. Contractors and homeowners wanted a little more flexibility in terms of who they could use for that." He added that the city has handled each C&D provider as a separate, identical franchise agreement and that the Earth Hall LLC franchise is the 17th of that type.
There were no public comments opposed to the ordinance during the hearing, and the council adopted the second reading by roll call. Council member Scott French was recorded voting "Aye," and Mayor (recorded as) Waddes also voted "Aye." The ordinance was declared adopted.
The franchise ordinance and related documents define the terms and conditions under which a nonexclusive hauler may operate; the city clerk's office will post the finalized franchise documents and effective date as required by the city charter.
No financial terms specific to the Earth Hall LLC franchise were presented aloud at the meeting. The council handled the item on the consent agenda and did not expand the record with additional contract details at the time of adoption.
