Council approves abandonment of century‑old section‑line right‑of‑way near Maricopa Road

Derek Shearer of the city planning department told the City Council on May 16 that the city initiated several right‑of‑way abandonment cases to remove a 1922 county‑dedicated section‑line strip that runs between sections 27 and 28 and is now largely built over.
Shearer said Pinal County’s 1922 dedication left 33 feet on each side of the section line, but later road alignments (including Maricopa Road and the ADOT overpass) left a long, unused strip that the city has no intention of developing. The abandonment requests cover multiple discrete parcels owned by private entities (Desert Cedars Equities LLC; Roadhouse Blues Holdings LLC; Wildcat Landscape Supply LLC; the Butts Family Trust; EHCLP; 20X Properties; the Trustees of the First Baptist Church) and city property.
Staff said it notified utilities and public agencies, posted signs on May 4 and received no public comments prior to the hearing. The city engineer supported abandonment and staff recommended approval subject to conditions identified in the staff memo.
Councilmember Gettle asked whether a planned pedestrian overpass alignment would be affected; city staff showed the bridge connection and said the abandonment area lies east of the overpass route and would not affect the planned pedestrian connection. A motion from Councilmember Marsh, seconded by Councilmember Wade, passed with council approval.
The council approved eight abandonment resolutions (ABDN‑23‑02‑04 through ABDN‑23‑02‑10) as presented; staff will complete recordation and any conditions required by the staff memo.
