Resident urges formal plan and clearer maps as commission continues sludge-landfill enforcement order

A member of the public told the Gardner Conservation Commission that the inspection report and map for the City-owned sludge landfill are informal and fail to show the containment liner and leachate collection area, and urged the commission to require a written remediation plan from the Department of Public Works and the landfill operator.

"It looks like a lot of hand scratches," the commenter said about a hand-updated map, adding: "there's no demarcation of the containment area, which has been my concern from the beginning." The commenter also said he had seen ponding and had not been provided pump volumes or a formal report on what caused the leaks.

Commissioners said they had no new DEP update and that no one from the city or the landfill operator was present. The commission voted to keep the enforcement order open and to request a fuller written report, testing results, and for Department of Public Works staff and the contracted operator (identified in prior meetings as Viola) to attend the next meeting on May 12.

Commission members directed staff to contact named city contacts (Dane and Rob Oliver) for updates, and to request clearer documentation that distinguishes stormwater management failures from leachate collection system performance inside the containment area. The commission recorded that the last test results in their packet dated from March 28 and asked staff to obtain any subsequent monitoring data.

A motion to continue the enforcement order to the commission's May 12 meeting passed unanimously; the commission requested a formal report that explains cause, operations-versus-infrastructure contributions, pump volumes, and a corrective-action plan with timelines and operator presence.
