Resident seeks city help after property rezoned to commercial while permits pending

During the public-comment portion of the April 22 meeting, Kathy Frankaville said she was speaking on behalf of her brother, Russell Worthen, who purchased a lot in North Port and worked for more than a year to secure permits and surveys for residential construction. Frankaville said she was surprised to learn the parcel had been rezoned to commercial and asked the commission for guidance about whether she could proceed with construction or get access to the property.
“I just need he needs some answers,” Frankaville said, describing cleared brush, surveys and permits already paid for and saying, “We need boots on the ground. We need to be on the property.”
A staff member offered to have planning and building staff follow up, noting the city is aware of similar cases and that staff may be able to make accommodations within the city’s authority. The staff member asked for contact information so they could investigate options and coordinate next steps.
No zoning code section, ordinance number or formal appeal process was cited during the public comment; the resident asked for staff assistance and staff pledged a follow-up contact to determine options for the property owner.
