Clayton County State Court accepts multiple pleas, imposes sentences and probation conditions during jail calendar

Clayton County State Court Judge Tammy Long Hayward presided over a jail and probation calendar on April 29, 2025, during which multiple defendants entered pleas, the court imposed sentences or probation conditions and several matters were continued. The court heard negotiated pleas and sentencing recommendations from the state and defense for criminal trespass, traffic and probation-revocation matters.

Other outcomes included accepted pleas and suspended portions of sentences in multiple criminal trespass cases: Marshall Jerome Allen (2025CR03767) pleaded guilty and received a 12-month sentence with 18 days to serve and the balance suspended provided he have no violent or harassing contact with Lakeshia Johnson; Melissa Rochelle Brooks (2022CR00621) pleaded guilty to criminal trespass and was sentenced to 12 months with 30 days to serve, balance suspended, with an order not to return to 624 Fayetteville Road and no violent or harassing contact with the victim, Grady Bailey; and Aaron Alicia Robinson (2025CR03746) pleaded guilty to criminal trespass at the Hartsfield–Jackson Atlanta International Airport and was sentenced to 12 months with 15 days credit for time served, balance suspended, and ordered not to return to the airport except for official travel.

Traffic and vehicle-related pleas were also accepted. Jose Gonzales Aguilar (2025CR03798) entered no-contest pleas to driving with expired registration, hit-and-run and failure to yield; the court imposed concurrent 120-day terms with suspended fines (the state recommended suspended fines of $300, $500 and $100 respectively) and credit for time served. Myron Jermaine Franklin (2025CR03774) entered a no-contest plea to criminal trespass at a MARTA location and received 12 months with 12 days to serve, balance suspended, and an order not to return to the MARTA location at Hartsfield–Jackson Atlanta International Airport.

In cases arising from harassment and obstructing emergency calls, Antoine Deshaun Breeding pleaded no-contest in two matters arising from conduct directed at a former partner. For the first case (2025CR01628) the court accepted the recommendation of 12 months with 21 days to serve, 40 hours of community service, anger-management and no contact with Jaquan McCray; a second case (2025CR03775) was ordered to run consecutive but was suspended on the condition of continued no-contact and related terms. The court emphasized that any future contact could trigger revocation and possible aggravated-stalking charges.

Several matters were continued or administratively handled: Jahad Hamilton Cruz’s two older cases were continued for one month to allow probation outcomes to develop; Corey Myers was transferred to another judge’s courtroom and continued for two weeks; Jalen Pearson’s alleged bond-revocation motion was withdrawn by the state; and Ashley G. Swan’s arraignment was entered as not guilty and the court agreed to sign a bench-warrant recall after the state prepared the paperwork. The court also discussed logistics about bringing detained defendants from other counties and appointing counsel when needed.

Judge Hayward repeatedly warned defendants that violations of probation or bond conditions — including direct or third-party contact with protected persons and failure to report — could result in revocation, additional charges or incarceration. The court set reporting or follow-up dates where required and directed defendants to obtain evaluations, counseling and provide proof of attendance when ordered.

Court staff and attorneys made several practical arrangements on the record: counsel requested interpreters when needed, arranged for appointed counsel in jail cases, and the court used breakout rooms for attorney-client conferences with jailed defendants. The court closed by noting a letter it had received on an unrelated traffic matter and said it would forward the correspondence to counsel to avoid ex parte communication.
