In cause 24 CPR 041453 the court found by clear and convincing evidence that S.D., an 18-year-old with autism and intellectual disability, is totally incapacitated and in need of a guardian with full authority over his person. The court appointed Mona Desai and Prashant (Reshot) Desai as guardians of the person and set bond at $50 each.
Mona Desai testified she has cared for S.D. "all his life," that he requires ongoing support for daily living and education and that less-restrictive alternatives such as powers of attorney or supportive decision-making are not appropriate at this time. The Desais completed the court's JVCC/background requirements and acknowledged duties including annual reporting and notifying the court of a change of address.
The court discharged attorney ad litem Robert Franks from duties and awarded him a fee of $650. The judge instructed the new guardians to file the required annual reports timely and noted court staff and the court website for assistance with forms.
