Fort Bend County Court at Law No. 1 on the record in cause 12 CPR 024901 found by clear and convincing evidence that Zachary Warford is totally incapacitated and in need of a guardian with full authority over his person, and appointed Laura Mendez as successor guardian of the person.
The judge also granted the request to allow the current guardian, Johnny Warford, to resign. The court set bond at $50 for the successor guardian and reminded Mendez of the obligation to file an annual report with the court.
Mendez, who testified she has known Zachary for 27 years and visits him at Richmond State Supported Living Center in Richmond, told the court she had completed required guardianship training and has no criminal convictions. She said she and Zachary's current guardian have coordinated care and that she will continue to visit him regularly. "Absolutely," Mendez responded when asked whether the guardianship should continue.
During the hearing, counsel questioned Mendez about her familiarity with Zachary and her willingness to carry out guardian duties. After testimony, the judge stated: "After listening to the testimony, the court finds by clear and convincing evidence that Zachary Warford is totally incapacitated and still in need of a guardian with full authority over his person. I will grant the request of Miss Mendez and appoint her a successor guardian of the person with bond set at $50." The court advised Mendez to file annual reports timely.
No assets or financial guardianship were reported for Zachary during the hearing; the record states Zachary "does not" have assets. The appointment covers only guardianship of the person as reflected in the court's ruling.
