The Marshall County Planning Commission voted to approve PC-25-PC-07, an application by James and Rita Schmidt to subdivide approximately 3.62 acres from a 23.73-acre parcel at 4900 French Street in Plymouth, at its April 20 meeting.
Staff recommended approval after finding the proposed lot meets T1 residential setbacks, has existing well and septic service, provides access to French Street, and conforms to the county's subdivision regulations and comprehensive plan.
Commission staff presented findings stating the subdivision met standards for conformance with subdivision regulations, consideration of natural features, pollution prevention, subdivision layout and street design, and that no new streets would be created.
During the public hearing, resident Jerry Ross, whose property is directly east of the parcel, asked whether the Schmidts intended to sell the lot to a sibling and raised concerns about other family members and trustees not being informed. Ross said his neighbor "didn't know what they were doing" and noted there are multiple siblings involved in the family trust. Applicant James Schmidt told the commission the split was intended to sell the lot to his sister.
The commission responded that disputes or trust matters between family members are civil issues outside the commission's purview. The commission chair noted the board's review was limited to the subdivision application and the findings on the record.
After discussion, a motion to approve PC-25-PC-07 passed on roll call with five votes in favor and one abstention. The record shows:

Commission staff arranged to have the recordable documents signed after the meeting.
The applicants at the hearing were Rita Schmidt Lammert and James Schmidt; James McLaughlin of Whiteman Associates assisted with the presentation. The commission's decision was based on the findings presented by staff and the record created at the public hearing; no zoning variances or new streets are part of the approval.
