Planning commission backs rezoning of 0 Horn Tavern Road to R-20 to correct nonconforming lot (PC 18-25)

Fairview’s Planning Commission voted April 8 to recommend rezoning the 0.56-acre parcel on the east side of Horn Tavern Road from RS-40 to R-20 (PC 18-25). Staff said the lot is legally nonconforming under RS-40 because it measures 24,819 square feet — smaller than RS-40’s 40,000-square-foot minimum — and that rezoning to R-20 would bring the parcel into compliance with the zoning code.
Philip Caldwell, the owner, was present and did not add commentary. Mayor Mary Anderson said the rezoning made sense because the lot was not compliant with RS-40 and the requested zoning is listed as appropriate in the comprehensive plan. The commission’s favorable recommendation will be forwarded to the Board of Commissioners for consideration on May 1, with a potential public hearing and second reading on June 5.
Vote: The motion to recommend approval passed unanimously.
