Needham conservation staff say contractors fixed sediment and tree-protection issues at two Gary Road sites

Needham Conservation Commission Chair Dave Harrer reported that residents alerted staff to sediment flowing past silt controls, buried tree root zones and dewatering activity at two construction sites on Gary Road.
Harrer said he visited the sites, discussed the problems with conservation staff member Deb and that contractors have since “pulled the soil away from the trees.” He also told commissioners he did not see a dewatering plan at 74 Gary Road and that there is compaction and some soil remaining in the trees’ drip zones.
The chair said the contractors at 74 Gary Road “fixed it the following day” after being contacted and that overall he judged the parties to be cooperative. Commission member Fred (last name not specified) recommended asking for fencing around the drip zone at large trees to prevent further compaction; Harrer said that in many cases it was already too late given where stockpiles had been placed.
Commission members discussed the limits of the town’s existing tree-protection guidance. Harrer noted the commission’s new tree policy describes protection strategies but said the regulation should be more explicit for projects affecting large trees so applicants clearly understand requirements before work begins.
Commissioners also discussed 80 Gary Road, which Harrer said had a superseding order of conditions issued by the Massachusetts Department of Environmental Protection (MassDEP) after an appeal. Harrer and Deb told commissioners that whether MassDEP “takes over” an appeal can depend on which DEP reviewer handles the file.
No formal enforcement vote was taken at the meeting. Harrer said staff contacted the contractors and that the major issues were corrected; he asked staff to follow up as trees are backfilled near foundations and to consider stronger preconstruction requirements (for example, tree protection installed prior to preconstruction meetings).
The commission encouraged members to inspect active sites in person: Harrer said site visits often “open the eyes” of commissioners by showing how plans match field conditions.
Commission action and next steps recorded during the meeting require staff follow-up and possible regulatory clarifications rather than immediate formal enforcement.
