Committee approves appraiser-rule updates required by federal standards

The committee voted 9-0 to adopt changes to South Carolina’s real estate appraiser regulations (Document 53-40) so state licensure and continuing-education requirements match standards set by the Appraiser Qualifications Board (AQB) and Act 196 of 2024.
A staff presenter said the packet before the committee explained the relationship between federal law, the Appraisal Foundation and the AQB, and the federal requirement that applicants comply with AQB standards. The presenter said compliance is necessary for appraisers to participate in federally related transactions governed by the federal law the presenter cited as “FIRIA.” The presenter summarized changes including revisions to education and experience requirements for licensure, updates to continuing education and removal of outdated provisions.
Holly Beeson, representing LLR, told the committee the AQB standards take effect Jan. 1, 2026, and that the changes add continuing-education hours for licensed credentials while certified credentials will not see a net increase because their total education requirements were adjusted. Beeson said the state must follow federal standards to ensure appraisers can participate in federally related mortgage transactions.
Representative Taylor questioned the value of continuing education and urged boards and LLR to seek higher-quality providers; Beeson said continuing education quality varies and LLR attempts to identify trusted providers.
Representative Neese moved approval of the regulation and asked that the committee formally request LLR promulgate emergency regulations to remove these provisions if federal requirements later change. The motion was seconded and approved on a 9-0 roll-call vote.

The committee recorded no change to state policy beyond aligning state regulation to the cited federal standards and requested that LLR be prepared to adjust rules promptly should federal guidance shift.
