The Bexley Board of Zoning and Planning on a unanimous vote approved a certificate of appropriateness and an 11 and 3/8-inch area variance to allow the owner of 2832 East Broad Street to enclose an existing porch that encroaches into the side-yard setback.
The action implements a recommendation from the Architectural Review Board and responds to a staff finding that the porch encroaches 11 and 3/8 inches into the eight-foot side-yard setback for the R-? zoning district. The application sought approval to infill between an existing roof and existing slab without changing the porch footprint.
Staff told the board the porch is "existing nonconforming" and that no prior variance for that portion of the house could be found, leading to the need for the current variance request. The board accepted the ARB recommendation and moved to adopt findings of fact and conclusions of law that authorized a certificate of appropriateness and the requested variance under Bexley code section 1252.09.
The vote to approve the findings was moved by Mr. Schick and seconded by Ms. Dorn. The board recorded unanimous affirmative votes by Mr. Marsh, Mr. Schick, Mr. King, Ms. Dorn, Mr. Eshelbrenner, Mr. Rosenthal and Chairman Behar. The certificate of appropriateness and the variance were granted.
The owner may proceed with the porch infill consistent with the approvals and any building-permit requirements.
