Liberty County approves competitive-bid exemption for jail repairs

The Liberty County Commissioners Court voted in a special April meeting to exempt certain purchases related to repairs at the Liberty County Jail from competitive bidding requirements under Chapter 262 of the Texas Local Government Code.

County attorney’s office staff presented an order that would authorize exemptions to the county’s normal procurement process for purchases exceeding $50,000. Matthew Poston, representing the County Attorney’s Office, told the court that the order lists three statutory bases the court may cite when granting exemptions: public calamity, damage to public property and the preservation and protection of public safety. Poston recommended the court adopt the order.

The court moved and voted to approve the exemption. The vote was taken by voice; the court chair called for those in favor to say “aye,” and the motion carried. The court did not record a roll-call vote or a numerical tally in the meeting record.

The county’s presentation tied the procurement exemption to a “second remedial order” from the Texas Commission on Jail Standards that pertains to repairs at the current Liberty County Jail. The order presented to the court describes the statutory authority under Chapter 262, Texas Local Government Code, that allows a commissioners court to exempt a purchase from competitive bidding when one of those bases is met.

Court members did not record extended debate on the specifics of the repairs or alternative procurement approaches in the meeting transcript. After the vote the court immediately adjourned.
