Brown Deer trustees clear old development covenants, proclaim Arbor Day and approve state road agreements

Brown Deer trustees voted on several routine and project-related items during their April 21 meeting, approving the termination of legacy development agreements tied to the village marketplace, adopting an Arbor Day proclamation, and advancing the state-backed North Green Bay Road/State Highway 57 reconstruction project.

The board unanimously adopted Resolution 25-06 to terminate old development agreements affecting parcels in the village’s marketplace ahead of an anticipated closing for a buyer identified in meeting materials as Woodsonia. The village’s development attorney, Alan Markovitz, reviewed the item and recommended approval, and trustees said the outstanding issues with Kroger and other parties had been resolved pending the closing date. The motion to adopt 25-06 was moved by Trustee Greaves and seconded by President Montgomery; Trustees Johnson, Gries, Thompson, Booker, Woods, Mullins and President Montgomery recorded votes in favor and the resolution was adopted.

Trustees also adopted Resolution 25-07 proclaiming Monday, May 12, 2025, as Arbor Day. The motion to adopt was moved by Trustee Thompson and seconded by Trustee Greaves; trustees recorded their assent and the resolution was adopted.

On infrastructure, the board approved two agreements required to advance the North Green Bay Road/State Highway 57 reconstruction project: a revised state–municipal financial agreement and a revised state–municipal maintenance agreement. The financial agreement (to obligate local shares and allow the project to be advanced into state design/letting) was moved by Trustee Owens and seconded by Trustee Thompson and carried unanimously. The maintenance agreement (to accept responsibility for new sidewalk and other local elements after construction) was moved by Trustee Woods and seconded as recorded; trustees voted in the affirmative and the item passed.

The consent agenda, approved earlier in the meeting on a motion by Trustee Thompson and seconded by Trustee Owens, included minutes from the April 7 meeting and a contract award for the 50th Street reconstruction project to Vinton Construction Company. Staff said the roadway portion of that project will be less disruptive than the upcoming bridge work, and that a public information meeting for residents will be scheduled before major closures.

What the votes mean: terminating the old development covenants clears title obstacles ahead of the marketplace parcel closing; the state agreements put the North Green Bay/State 57 reconstruction on the schedule for later design and construction phases while assigning the village long-term maintenance responsibilities for newly added sidewalks and other local elements.
