Board approves Chastain Road contract and holds condemnation item for Pete Shaw Road after constituent concerns

CobbDOT asked the board to award a construction contract to CW Matthews Contracting Company Inc. not to exceed $705,730 for the Chastain Road at Busby Drive project (Project B2445). The board approved the contract by voice vote, recorded as 4‑0, and authorized the necessary budget transactions and execution of documents.
Later on the transportation agenda, staff asked the board to authorize condemnation proceedings by declaration of taking on two parcels for the Pete Shaw Road improvement project (Project B2732). Commissioner Burrell said neighbors had petitioned for sidewalks along Pete Shaw and that right‑of‑way staff had worked with property owners; she asked for a meeting with affected residents before the county moved forward. County staff advised condemnation is a last resort and recommended continued coordination, but offered to withhold the agenda item if the board preferred.
Following the exchange, commissioners agreed to withdraw/hold the condemnation item to allow the commissioner and staff to meet with property owners; no condemnation action was taken at the April 22 meeting.
During public comment earlier in the meeting, Paul Hurley, a resident of the Kennesaw Acres neighborhood, asked the board to formally recognize Loring Way as a public road and to avoid obligating him to repave what he said the county previously improved. County staff indicated the department of transportation and community development staff would follow up with Hurley.
The board also discussed compensation categories used in right‑of‑way acquisitions (fee‑simple takings versus temporary construction easements and temporary driveway easements). Staff noted a sample parcel for Pete Shaw would involve a fee‑simple right‑of‑way strip of approximately 2,623 square feet while leaving roughly three acres for the property owner; temporary construction easements and driveway work were also described as part of acquisition negotiations.
