Board orders CVS property to restore landscaping by May 23 after noncompliance

Inspector Robert Rolfe (presenting as Robert Robicheaux) told the board that the property’s plantings did not match the approved landscape plan: several shrubs were declining or missing and areas that require shrubs or ground cover showed bare soil. Rolfe said he sent the violation notice on Jan. 22 and that photos taken the morning of the hearing showed no change.
The board voted to find the respondent in violation and entered an order requiring the respondent to install the missing shrubs and ground cover as specified on the approved landscape plan by May 23, 2025. If the respondent does not comply by that date, the board authorized fines of $250 per day per violation. The order also restates the city’s authority to record a lien and pursue foreclosure, collection or settlement if fines and fees remain unpaid three months after a lien is filed.
A board member noted the property had been closed and was currently for sale; staff confirmed it is not abandoned but in active ownership and marketing.
The board carried the motion by voice vote.
