Zoning board continues Black Belt special-exception hearing to May 19 after developer cites traffic study delay

The West Swanzey Zoning Board of Adjustment on a motion agreed to continue the public hearing for a Black Belt special‑exception application to May 19 after the applicant said a traffic study remains pending.

Board members granted the continuance with a friendly amendment that the May 19 date would be the applicant’s last extension. The board’s decision keeps the application on the agenda while the planning and zoning staff await the traffic study that staff and board members said is necessary to evaluate potential impacts on the state highway near the site.

The Black Belt representative, Mark Baudrillard, told the board the applicant requested more time because the traffic study is not yet complete and they are “hopeful it will be soon.” Adam, the town planning staff member, confirmed the applicant has not provided updated plans or a timetable beyond the traffic study and that the planning board had continued its separate review to May 8.

Board members discussed options if the applicant fails to provide adequate information. A board member noted that if the board were to deny the application without prejudice, the applicant could refile later; the board would have to re-notice and reopen a public hearing in that case. Several members said they preferred to avoid repeated hearings and encouraged the applicant to submit a full application that includes the traffic study.

The motion to continue the ZBA hearing (filed on the agenda as ZBA25-02) was made and seconded, a friendly amendment was accepted making the May 19 continuance the last extension, and the motion carried. The board will revisit the application at its May meeting; the planning board remains scheduled to consider related items on May 8.

What happens next: The applicant is expected to deliver the traffic study and any additional plans in advance of the May hearings so the board and staff can complete their reviews.
