Committee considers moving justice‑of‑the‑peace nomination deadline earlier to reduce ballot errors

The Senate Government Operations Committee discussed proposed changes in H.474 that would move the deadline for party nominations and independent petition filings for justices of the peace (JPs) earlier in the calendar year.

Deputy Secretary Lauren Hibbert told the committee the House amendment moved a JP nomination deadline from after the primary to the third Monday in July so clerks would have more time between the primary and ballot production for the general election. Hibbert said JPs’ names go on the November ballot (not the August primary ballot), and the post‑primary schedule produced a tight production window for clerks and the Secretary of State’s office.

Hibbert noted many town clerks are part‑time and the compressed schedule after the primary increases the risk of typos and other errors on ballots. She said the change would give clerks time to enter nominations, allow SOS staff to proof names and reduce last‑minute corrections during the “bride‑in” ballot production crunch.

Committee members discussed whether JPs should be required to file consent forms and whether those consent forms should be used as the authoritative name source. Senators suggested a consent form could reduce errors if it were the formal record the clerk uses to enter a candidate’s name; Hibbert agreed that a consent form could be useful and noted clerks currently use local processes for receiving JP nominations.

The committee did not take a vote. The SOS office said it supports the July deadline and will work on clear statutory language to reduce ambiguity about nomination timing and the status of removal for cause language in the draft.
