The Port Hueneme City Council reported April 21 that, following a closed session on anticipated litigation, the council voted to direct staff to initiate legal action.
City Attorney (name not stated in the public record) told the council the matter fell under Government Code section 54956.9(d)(4) and that the council, by a 4–0 vote with one recusal, provided direction to initiate the action. The attorney said the defendants and further particulars would be disclosed once litigation is formally commenced unless release of those details would jeopardize service of process or settlement negotiations.
Mayor McQueen LaShawn called for disclosures of conflicts of interest before the closed session; one council member said they lived “approximately 984 feet from said property” and recused themselves from the matter.
The report to the public was brief and limited to the procedural facts required by law: that direction to initiate litigation had been given and that, to the extent the city’s ability to pursue settlement or to serve process is not prejudiced, additional details will be disclosed upon request.
The council provided no additional public detail about the nature of the threatened litigation, the identity of the defendant(s), or any timeline for filing.
