Manasseh said the request removes prior package‑sale entitlements and will limit the establishment to restaurant service; he told the hearing officer the adjacent residential area does not include dwelling units within the 150‑foot buffer and that the nearby Sylvan Learning Center is a small private tutoring operation.
County Development Services reported no issues with the waiver requests and recommended approval; staff noted the proposed permit would be less intense than the existing approval. No public speakers testified in opposition. The hearing officer closed the record on the special use; staff’s recommendation will be included in the administrative record and a written decision will be issued.
