Thompson Fuel Inc. asked the Land Use Hearing Officer for a 2‑APS alcoholic beverage permit and distance‑separation waivers to allow sales at an existing convenience store with fuel at 403 South U.S. Highway 41 in the Ruskin area.
Tanya Cappella of Development Services told the hearing officer staff had reviewed the proposal and found the proposed “wet zone” would not pose significant impacts to surrounding land uses because it is separated from the Ruskin Woman’s Club by a vacant commercial parcel, a water body and vegetation. Cappella told the officer the proposed wet‑zone footprint measures about 1,972 square feet.
Todd Pressman, attorney for the applicant, described the configuration and asserted that the site has an existing convenience store and historically permitted alcohol sales. Pressman said the measured distance to the Woman’s Club varies by method but is roughly 208–270 feet “as the crow flies,” shorter than the 500‑foot separation standard the code uses. He said the buffer of water and trees and the orientation of facades mitigates potential impacts. “We sent out 20 notices and there were no comments,” Pressman told the hearing officer.
No members of the public spoke in opposition. County staff recommended approval subject to conditions in the staff report. The hearing officer closed the item; a written decision will be issued in accordance with hearing procedures.
