City reports spring‑break beach enforcement activity; ice cream vendor trespassed, citations issued

Since the increased enforcement effort began, staff reported: one warning for a commercial activity that staff said was resolved quickly (a wedding), six warnings for soliciting or vending, two citations issued for vending, three warnings about chairs and foot‑traffic blocking, and three verbal warnings for animals on the beach. Staff also said there were four reports investigated where officers could not corroborate the violation at the time of inspection.
On a higher‑severity matter, staff said they trespassed one ice cream vendor from June White Decker Park for violating rules; the Okaloosa County Sheriff’s Office issued a one‑year trespass warning against that individual from park property. Staff said the trespass covered public park property and could be enforced as a criminal trespass if violated.
Staff also reported that a boat operator had been cited for using transient slips for commercial purposes; staff said sufficient evidence had been collected to take the matter before the city’s code magistrate. Council members asked for clarification of the trespass effect — staff said the trespass applies to public park property and is enforced by the sheriff.
Council members asked staff for a roll‑up of spring‑break parking citations and information about long‑term plans, including a request to see the raw counts for parking violations and warnings. Staff provided a figure for parking enforcement from January 1 to the meeting date: 142 parking citations and 202 warnings issued through the city’s parking system.
Council members and staff discussed whether allowing regulated vending on the beach would reduce confrontations and cited resource constraints — the city’s code department was operating with reduced staff (staff said they were down from roughly eight officers in prior periods to five, and down to four by the coming Friday), and council members noted that enforcement is labor‑intensive. Staff welcomed clearer policy direction from council on vending and the permitted footprint for vendors.
No formal policy change was made; staff said the city will continue enforcement, coordinate with the sheriff’s office and return with requested roll‑ups and additional enforcement data.
