The Yarmouth Conservation Commission continued a Certificate of Compliance (COC) hearing for 122 Exeter Road on April 17 after finding discrepancies between the approved plan and field conditions, including a missing or undersized swale and tree plantings that do not meet species or caliper specifications.
Karen (Conservation staff) and Kieran Healy, land surveyor with the BSC Group, described on‑site conditions: Healy said the site includes a narrow swale adjacent to a fence on the northwest side about 1 foot wide and 4–6 inches deep that captured water during a rain inspection, and that six trees had been planted (two red Japanese maples, three Kusa dogwoods and one sycamore) though the species and sizes differ from the approved plan. Healy said the downspouts are directed to dry wells and a 500‑gallon leaching pit was proposed to capture roof runoff.
Commissioners said the tree selection and size were insufficient compared with the plan’s requirement (two‑inch caliper standard and native species requested). Several commissioners said they would not support issuing the COC in the package’s current form. One member suggested a partial COC for the new dwelling, but other commissioners worried a partial COC would remove leverage to ensure planting and monitoring requirements are completed.
The applicant’s representative asked for a one‑month continuance to coordinate larger plantings and to increase the size of the swale adjacent to the fence. Commissioners requested a clear plan showing the swale cross‑section and a planting schedule; the owner committed to attempt to widen the swale to about 2 feet by 6 inches and to return with documentation. The commission voted to continue the hearing to the May 15 meeting.
