DuPage County Zoning Hearing Officer Robert Cartel recommended approval on April 16 of two corner‑side setback variances for case "25 0 8 Smiley" and adopted minutes from two April 2 meetings.
Cartel said the petitioner requested a variance to reduce the corner‑side setback for a new deck from the required 30 feet to approximately 10 feet, and a variance to reduce the corner‑side setback for a new front porch from the required 27 feet to approximately 20 feet. Cartel found the petitioner had offered "compelling testimony" and that "all of the required, statutory requirements for variation requests have been met." He also noted the front porch will replace an existing long‑standing porch and that, without relief for the rear yard, there would be no interior access because of the elevation of the second‑story entrance, leaving no other feasible location for the rear stairway porch.
As part of the recommendation, Cartel included standard conditions, notably maintenance of the landscaping perimeters. He signed the recommendation document and said it will be transmitted to the County Development Committee at its next meeting. No public comment was offered at the April 16 recommendation meeting. Cartel also reviewed and adopted the transcripted minutes of the Zoning Hearing Officer public hearing of April 2, 2025, and the Zoning Hearing Officer recommendation meeting of April 2, 2025, stating he had no corrections.
The recommendation is not a final county decision; it will be considered by the County Development Committee at a future meeting. The Zoning Hearing Officer closed the recommendation meeting after announcing there was no additional new or old business.
