Energy Facility Site Evaluation Council staff told the council they plan to file final rulemaking to update and correct language across the agency's Washington Administrative Code (WAC) chapters.
David Walker, interim director of administrative services, said the proposed changes are non‑substantive housekeeping that update agency contact information, references to statutes and public records procedures, correct typographical errors, and improve clarity in 24 of the 26 chapters of WAC title 463. Walker said the rulemaking began July 23, 2024, and was initially filed as expedited housekeeping; an objection required conversion to a proposed expedited rulemaking and a CR 102 pre‑notice inquiry, which extended public comment and prompted a formal public hearing held Nov. 7, 2024.
Walker told the council staff will present a final CR 103 for council action at the May regular meeting. Chair Kurt Beckett said the redline showing all amended chapters is linked in the packet and that staff should proceed with the public process for final action if the council concurs.
Why it matters: Updating outdated WAC references and contact information reduces administrative confusion and aligns FSEC rules with statutory changes following the agency’s 2022 reorganization; the changes are intended to be nonsubstantive.
