South Fulton staff holds statutory hearing on administrative variance for 3724 Cascade Road

Reginald McClendon, managing director of the Community Development and Regulatory Affairs Department for the City of South Fulton, opened a statutorily required hearing on an administrative variance request for 3724 Cascade Road (case AV 25001) in April 2025.

Administrative variances are requests for relief from strict application of South Fulton zoning rules when those rules impose a hardship on property development; they are governed by section 808 of the South Fulton zoning code, McClendon said. He told the room that Georgia’s recently amended zoning procedures law requires a hearing when a local government delegates variance decision authority to a quasi‑judicial officer.

The applicant, Brent H. Moy, P.E., asked to reduce a required 10‑foot landscape strip along the south property line to 2.5 feet and the 10‑foot landscape strip along the east property line to 5 feet, seeking relief from section 506.05(d) of the zoning ordinance. No members of the public filed opposition, and the board closed the hearing that evening.

“Following the hearing, I will produce a written decision within 7 days,” McClendon said on the record.
