House Energy panel asks PUC to propose revised 'single plant' definition for S 50, sets November report deadline

Wolf Meck, House Energy and Digital Infrastructure, opened the April 17 meeting by proposing an addition to S 50 asking the Public Utility Commission to develop and submit a proposed amended definition of “plant.”

Ellen Tchaikovsky, Legislative Council staff, read draft language that would require the PUC "on or before 11/01/2025, and with input from stakeholders, [to] submit a proposed amended definition of plant in 30 DSA section 8002 18 to the House Committee on Energy and Digital Infrastructure and the Senate Committee on Natural Resources and Energy." Tchaikovsky said the commission should consider "the land use benefits of colocation of energy generation facilities, the ability to ensure comprehensive review of colocated facilities, and the potential impacts to rate payers associated with colocated facilities."

The directive would make the PUC’s proposal a starting point for the committee to consider in the next session. "Whatever the PUC comes back with on November 1...simply becomes the starting point for another round of testimony and conversation," said a committee member.
