Council discusses loosening "unique art" rule for public art purchases

Keller councilmembers discussed whether the city’s public‑arts policy should be revised to allow greater flexibility when purchasing art for parks and roundabouts. Staff described the current policy requirement that art be unique and not displayed within 500 miles of city limits. Council members and staff said the buffer and a strict “unique only” rule can limit options and dramatically increase costs for public installations.

City arts staff displayed maps showing 500‑mile and 250‑mile buffers and reminded the council of past purchases: the “Playful Puppy” sculpture purchased in 2021 cost $40,000 for the piece plus about $8,000 for the pad, and total site installation costs approached six figures. Several councilmembers said prefab or previously fabricated pieces could be acceptable in some park settings if the purchase agreement included an exclusivity clause (for example, no resale or duplicate sale within a smaller radius).

“I would welcome a policy that at least gives us a little bit more flexibility,” Mayor Pro Tem McMullen said, adding that any purchase would still come through the public arts board and council approval. Council asked staff to draft policy language that preserves the integrity of acquisitions while allowing a practical exception for lower‑cost or prefab pieces when appropriate for parks, roundabouts or sports‑park contexts.

Staff will prepare draft policy language and seek input from the public arts board before returning to council for further direction.
