Emeryville council adopts updated development impact fees and amends master fee schedule

The development impact fees resolution (Item 11.1) was opened and closed with no public comment. A council member moved to approve the resolution and it passed on the roll call vote. The resolution's text as presented to the council was adopted; the staff report did not specify an effective date for the development impact fees beyond the resolution language.
On Item 11.2, Brian Mora of RGS presented the proposed amendments to the master fee schedule. He told the council the proposed schedule would be effective July 1, 2025, and said most fees were increased about 2.7% from the prior year. Key changes highlighted in the presentation included:
- A sewer connection fee adjustment using the ENR construction cost index (2.9%); staff estimated this change could generate about $5,600 in additional revenue in the coming year. - State-set fees (such as Department of Fish and Wildlife fees) remain subject to state timing and are not changed by the city. - A pass-through increase in credit/debit card processing fees from 2.5% to 3% for Community Services and Finance to reflect a new processor. - Removal of police DVD copy fees to align media fees across departments. - A proposed reduction in the sewer lateral performance security deposit based on Public Works cost studies. - Park rental fees converted from per-day to per-hour pricing to increase availability. - After-school program fees increased by 4% to reflect actual operating costs.
Council discussion included a request to study whether an administrative surcharge could be applied to reimbursable overtime for police detail work; staff recommended that be examined in a forthcoming comprehensive fee-study update after the budget process. The council then moved, seconded and adopted the master fee schedule amendment by roll call.
Ending: Both resolutions passed on unanimous votes of members present; staff will implement the fees per the adopted schedule and return with any follow-up studies requested by council.
