Council asks staff to bring Hyperion billing and odor-complaint issues back to council

Council members reported that the South Coast Air Quality Management District had received dozens of odor complaints over recent weeks and issued a notice of violation on April 10 for public nuisance. Councilmembers said the city has been acting as a billing intermediary for Hyperion customers and that residents have received erroneous charges which Hyperion later credited.
Council members asked staff to prepare an agenda item proposing that the city stop collecting Hyperion bills on the utility’s behalf if Hyperion continues to send bills that the city knows are incorrect. Council members also asked staff to follow up on the status of the Hyperion general manager recruitment and return with options for additional oversight; public works staff indicated they need time to calculate impacts and recommended two meetings to prepare the agenda item.
Deputy city staff reported that Hyperion performed regular cleaning of a battery tank April 11–15 and that AQMD continues to receive odor complaints (48 complaints in the prior two weeks, as reported). No formal council motion was made during the reports section; council directed staff to return with a detailed agenda item.
