John Matthew Fabian, a forensic psychologist and neuropsychologist, testified by Zoom that the defendant's early life exposure to instability, neglect and abuse created developmental risks that are relevant at punishment.
Fabian told the jury he reviewed juvenile probation records, police reports, a Tarrant County psychological evaluation (dated 11/15/2016) and interviewed family members and the defendant. "I ran analysis on your client, Mr. McIntyre," Fabian said, "and it revealed that he had eight of the ten [ACEs]." The expert described that result as "pretty high" and said a cumulative count of ACEs correlates with elevated risk for negative outcomes.

On brain development, Fabian told the court that the prefrontal cortex'the brain region tied to planning and impulse control'is last to mature. "The most important part of the brain would be developing, I'd say, by age 24," he said, summarizing standard developmental research and explaining why adolescents are more prone to impulsive acts than mature adults.
Limitations: Fabian said these research findings describe risks and correlations, not deterministic predictions. "You can't really predict what negative outcome someone will experience if they have these things," he testified, noting that ACEs increase probabilities but do not determine a single future event.
Why it matters: Fabian's testimony was offered to the jury during the punishment phase to provide context for mitigation, linking the defendant's life history and developmental profile to the court's decision about punishment. The judge allowed Fabian to testify but limited what portions of his prepared slides could be shown to jurors (the court removed slides that contained written statements of his conclusions).
