Bayside Landing marina: County assesses penalties, approves up to $30,400 and amends DNR agreement for electrical upgrades

Dan Mattson, Public Works director, briefed the board that structural elements (piers and bulkheads) were expected to be finished in about two weeks and that the county began assessing daily penalties to the contractor after the April 14 contractual completion date. He said the contractor acknowledged responsibility for schedule delays and the county is documenting loss of revenue tied to unpaid slip fees.
Mattson described additional work related to electrical hookups and said the total contract cost increase for unspecified design/construction defects and upgraded electrical components was $69,420. He said the county has $8,620 in contract contingency available and that the Maryland Department of Natural Resources (DNR) agreed to increase its contribution on a 50/50 basis. Mattson requested a not-to-exceed amount of $30,400 from the county to allow work to continue while final responsibility determinations continue.
Commissioners voted to move $30,400 from fund balance to contingency, and then approved a motion to fund up to $30,400 from contingency for the county share of the additional work. Mattson also asked the board to approve the amended grant agreement with DNR, which commissioners approved. Mattson told the board that DNR has committed to the county's requested amendment confirming a 50% share of the additional costs.
Mattson added that DNR has increased and clarified Waterway Improvement Fund limits and programs that could benefit future projects, including higher maximum grants for marinas and emergency repair awards.
The board approved three motions in succession: reallocation of $30,400 to contingency, authorization to expend up to $30,400 from contingency for the marina work, and approval of the amended memorandum of understanding (grant agreement) with DNR to confirm the 50/50 funding split.
