Senators said disputes are arising where municipalities view a venue or activity as commercial development while farmers consider the same structures and activities part of agricultural operations.
Legislative counsel and senators described past miscellaneous agricultural bills that included definitions addressing farm structures and accessory businesses. Committee members discussed approaches such as clarifying accessory-on-farm business criteria, allowing a limited number of permitted recreational or educational events per year, or requiring towns to issue event permits so municipalities retain local control over noise, parking and other impacts.
Counsel noted jurisdictional overlaps among Title 6 (agriculture), Title 10 (conservation and Act 250 land-use authority), and Title 9 (weights and measures). Senators suggested language that would allow municipalities to approve events on a case-by-case or permit basis while preserving the ability to regulate traffic, noise and public-safety conditions.
The committee asked counsel to circulate draft accessory-business language developed with Senator Majors and other staff; no vote was taken.
