Oshkosh council adopts rules clarifying closed-session attendance after debate over 'irrelevant matters' provision

The Oshkosh Common Council voted April 15 to adopt its council rules with an added clarification on closed-session attendance, after members debated but did not adopt a proposed restriction on agenda items described as "political or ideological." Council members voiced concerns about who would define such categories and whether the change could limit the council's authority under the Wisconsin Constitution.
Mayor Matt Mugebauer introduced two proposed amendments to the council rules, saying they were written "to maintain civil dialogue and have a little bit of guardrails on what we're asking staff to expend their time on." One amendment would restrict adding agenda items "on state or federal legislation that does not directly and explicitly impact the city," items concerning political or ideological topics, and items that support or oppose a particular person or organization commonly known for a political stance. Councilmembers raised procedural and constitutional concerns about that wording.
"Who defines political or ideological topic?" Councilmember Nichols asked, arguing the Wisconsin Constitution and the city manager form of government supply the council's powers and that the proposed language could unduly limit council discussion. Several members agreed the concept had merit but questioned whether a hard-rule formulation would be workable. City Manager Grill said staff would consult with the city attorney if a council member asked to add a potentially political item and that the provision had been used in prior roles merely to clarify practice, not to block legitimate council business.
Separately, the council moved and approved an amendment to the rules to clarify attendance and who may be admitted to closed sessions when city business requires non-council experts or participants. That amendment and the final vote to adopt the rules as amended both passed by recorded roll call, with all seven members voting aye.
Councilmember Chris Larson proposed adding "postpone indefinitely" to the list of permissible council actions; after discussion and concerns about leaving matters in limbo, Larson rescinded the motion. The council also heard follow-up administrative items and will continue work on any remaining rule clarifications at a future meeting.
The adopted rule changes take effect immediately; councilmembers directed staff to bring any additional clarifications back for consideration at a future meeting.
