The committee reviewed a provision that would restore legislative approval for lease extensions of state‑owned railroad property.
Last year’s draft removed the General Assembly approval requirement for lease extensions. The current amendment would require either General Assembly approval or, if the legislature is not in session, approval by the Joint Transportation Oversight Committee (JTOC). The section also requires the secretary to notify the committees on transportation within 10 calendar days after entering into a short‑term lease or operating agreement (not to exceed six months) meant to preserve continuity of service.
Sponsors said the change would restore the legislature’s role in authorizing longer lease extensions, and the short‑term notice requirement preserves operations while ensuring legislative oversight. Committee members asked AOT to explain federal rules and the practical reasons AOT had requested last year’s change; staff said AOT would be asked to present background at a future meeting.
The section would take effect on passage; other sections of the draft retain the standard July 1, 2025 effective date unless the committee modifies effective dates.
