Select Board approves nonrenewal of three seasonal liquor licenses

The Nantucket Select Board voted unanimously April 14 to nonrenew three seasonal liquor licenses, opening one seasonal quota slot for new applicants.

The vote approved nonrenewal for Foggy Bottom Kitchen LLC (doing business as Foggy Nantucket), Berkeley Place Restaurant Limited Partnership and Nantaco Act LLC (d/b/a Nantaco at 21 South Water Street). Amy (staff member) told the board the licenses were nonrenewed after a transfer of location that “did not work out” for Foggy Nantucket and that Berkeley Place and Nantaco would also be nonrenewed for 2025.

The nonrenewals matter matters because Nantucket’s seasonal quota for off‑premise wine and malt or package store licenses is limited by the town’s seasonal population formula; when a seasonal license is nonrenewed the slot becomes available for other applicants. Amy said the Foggy Nantucket surrender followed an unsuccessful change of location and advised the board that the quota license will be important for “an upcoming hearing.”

Board member Matt moved approval; Malcolm seconded. The motion passed by roll call with Matt, Malcolm, Tom and the chair voting aye.

The board did not take further action beyond the vote; Amy confirmed the town had already completed other routine renewals earlier and that staff would handle follow‑up steps for notification and any upcoming hearings connected to the freed quota slot.

Looking ahead, the opened quota spot will be available to applicants under the town’s seasonal licensing rules; Amy noted that some applicants may be better served applying for new licenses rather than transfers if the timing or location is different.
