The Muskego City Planning Commission on March 4, 2025, approved a slate of routine annual reviews and land‑use adjustments and postponed action on two sites to allow owners time to complete required on‑site fixes.
The actions, taken during a meeting at which the commission declared a quorum, included unanimous approvals of several annual reviews and the removal of an outdated conditional use grant. The commission deferred a larger compliance review for Loomis Court LLC for six months so the owner can complete stormwater and driveway work near a wetland, and postponed final occupancy for Fleet Farm for one month while the store resolves the color/placement of an ice bin required to match the building’s appearance.
Why it matters: The decisions affect property operations and permitting across Muskego City, including continuing oversight of larger retail sites and the resolution of long‑standing permit conditions that affect final occupancy and site appearance.
Commission staff summarized compliance findings and recommended actions. Staff said the Loomis Court LLC site contains two buildings and an expanded outdoor storage area; some gravel and stormwater work near a wetland and driveway access have not yet been completed, and staff recommended deferring the annual review to the September meeting to give the owner time to finish the northeast portion of the site. The commission voted to defer the Loomis Court LLC annual review for six months.
Staff also reported that Fleet Farm had operated under temporary occupancy and that most outstanding items had been fixed after a February inspection and written notice. One remaining issue was an ice bin located in front of the gas station area that the commission’s original approval required be painted or wrapped to match the building; staff recommended a one‑month deferral to allow the store to work with its vendor on color or placement so the commission could issue final occupancy when that item is completed.
The commission accepted staff’s recommendation and postponed Fleet Farm’s final review for one month.
Other actions included unanimous approvals of annual reviews listed on the consent agenda — Durham Hill Auto (PC0042025), Schaefer Snowplowing and Grading LLC (PC0052025), Frye Auto (PC0062025), National Auto (PC0072025), North Cape Storage (PC0082025), Muskego Storage (PC0092025) — and a temporary garden center for AW Greenhouses (PC0132025). The commission also approved a metal accessory structure waiver for David and Wendy Hanaberry (PC0122025) after staff noted the proposed building’s decorative elements, distance from the road and lot configuration. The commission removed a 1995 conditional use grant for an in‑law suite at William and Kathy Nielsen’s property after staff confirmed the dwelling no longer functions as a two‑unit residence and that the owners requested removal; the city’s ordinance permits administrative removal when requested by the owner.
A rezoning request for John Jewel (PC0112025) was withdrawn by the applicant; staff explained the petitioner will proceed under the existing zoning and will not expand the lot count as previously proposed, so no action was required.
Votes at a glance: PC0032025 (Loomis Court LLC annual review) — postponed for six months to September (staff recommendation). PC0102025 (Fleet Farm one‑time/first‑year review) — postponed one month pending resolution of ice bin color/placement. PC0112025 (John Jewel rezoning) — withdrawn by applicant, no action. PC0122025 (Hanaberry metal accessory structure/waiver) — approved unanimously. PCU0142025 (Nielsen conditional use removal) — approved unanimously. Consent agenda resolutions PC0042025, PC0052025, PC0062025, PC0072025, PC0082025, PC0092025, PC0132025 — approved unanimously. Minutes from the Jan. 7, 2025 meeting — approved unanimously.
Meeting context and next steps: Staff said they performed the Loomis Court site inspection on Feb. 11 and will return the item to the commission after the owner completes the gravel, driveway and stormwater items. Fleet Farm staff and vendor were given one month to resolve the ice bin appearance requirement so staff can consider issuing final occupancy. The commission said it will next meet on Wednesday, April 2, 2025 (moved from Election Day, April 1).
