Commission recommends CSM at 7655 S. Sixth St.; will require development agreement to address tree preservation
Summary
The Plan Commission recommended approval of a certified survey map dividing 7655 South Sixth Street into two lots but required a development agreement to resolve large tree removal and compensation obligations.
The Oak Creek Plan Commission on Feb. 25 moved to recommend approval of a certified survey map (CSM) to split 7655 South Sixth Street into two lots, with conditions including a cross-access and maintenance agreement and a development agreement that addresses tree preservation compensation.
Staff explained that Lot 1 would contain existing improvements and be about 5.288 acres; Lot 2 would be a wooded parcel intended for development of a roughly 62,000-square-foot warehouse. Creating the two lots will reduce the green space on Lot 1 from above the city’s 30% requirement to about 18%, while Lot 2 would show about 44% green space; combined, the properties would meet an overall 31% green-space figure presented by staff.
A tree preservation report identified roughly 74 trees on Lot 2 that meet the city’s diameter threshold. Under city code, the developer would be required to replace those trees; staff said the quantity required (calculated as 528 replacement trees given the mix of tree sizes) cannot be accommodated on-site. Staff recommended a development agreement, to be drafted by the city attorney, that would outline compensation or other remedies in lieu of on-site replacement before any permits are issued or the CSM recorded.
Commissioners and staff discussed possible forms of compensation, whether funds would be used for tree planting elsewhere in the city, and the capacity of the public works/forestry program to plant or maintain additional trees. The commission also asked that the CSM show notation or an easement addressing an existing stormwater outfall structure that appears on city property so that ownership and maintenance responsibilities are clear.
The commission voted to recommend approval with conditions: technical corrections prior to recording; execution and recording of a cross-access and maintenance agreement between Lot 1 and Lot 2; a development agreement between the city and property owner to outline compensation for modifying tree-preservation requirements prior to recording and prior to issuing permits; and staff coordination on notation for the outfall on the CSM.
