Ruiz entered a no-contest plea on Jan. 28 and the court received a presentence investigation report. The State opposed Ruiz's application for probation. After a brief victim-impact presentation, Judge Boyd found the plea and the record sufficient and sentenced Ruiz to 10 years in the Texas Department of Criminal Justice, assessed a $2,000 fine and ordered restitution to the victim's next of kin, identified in court as Juanita Aldaca for the estate of Francisco Aldaca. The judge ordered credit for any time already served.
The court followed standard procedures for felony plea and sentencing admonishments, and noted the defendant waived his right to appeal under the plea agreement. The court denied the defense request to maintain jurisdiction for later reconsideration and proceeded to sentencing.
Victim-impact statements were received in court; the judge instructed those speakers they would be heard and explained the process. After the sentencing, the judge addressed Ruiz with comments about using the sentence as an opportunity to change and encouraged him to pursue rehabilitation.
