The Franklin City Plan Commission on March 20 recommended approval to allow a fence within a 30-foot landscape-easement plat restriction on Lot 22 of Riverview Pointe (6575 West River Pointe Drive). Staff said the fence was necessary to enclose a pool in compliance with the building code and recommended approval to send the request to the Common Council.
Planning staff explained the fence location and noted that, under the subdivision plat restriction, fences are prohibited in the landscape buffer unless the Common Council grants approval. Because pools must be enclosed under the building code, staff recommended the commission forward the request with technical corrections identified by the city attorney.
"This is an application for a fence that is encroached into a landscape buffer easement...staff recommends approval because it's actually a requirement for pools to be enclosed with a fence," planning staff (Martinez) said.
Commissioners approved the motion to recommend the resolution (with the city's technical corrections) on a voice vote. The item will go to the Common Council for final action; staff noted permit issuance will follow council approval and any necessary technical corrections.
