State Board reviews territory-transfer process, approves Green Local to Worcester City transfer

He said these petitions are eligible in even-numbered years and “were due by April 1 of even numbered years.” He described two common petition paths: petitions submitted by individual property owners or qualified electors and transfers initiated by school districts, and explained the board’s role when parties either request a hearing or waive it.
The training covered threshold requirements: a petition must concern property contiguous to the receiving district; when residents live on the parcels the petition requires signatures from at least 75% of the qualified electors residing on the property, and when no qualified electors reside there it requires 75% of property owners. The counsel described the county Board of Elections’ role in verifying petition signatures and the sending district’s obligation to provide a boundary map, then the State Board’s administrative review under its rules. He said the board’s administrative rule set includes a standard information request to involved districts (25 questions) and explained that if no hearing is requested the board performs an evidentiary review of the submitted record.
On the transfer before the board this month, the parties expressly waived their right to a hearing and agreed to an evidentiary review. The board approved the resolution to transfer territory from Green Local School District to Worcester City District by a roll-call vote of 17 to 0. Member Florey made the motion; Member Lloyd seconded.
The chief counsel reminded the board that board action is not the final administrative step: the receiving district must adopt a local resolution to accept transferred property, and he noted that Ohio Supreme Court precedent indicates a transfer is not complete unless the receiving district follows that statutory step.
Board member questions included a request for clarification about the meaning of “qualified elector.” The chief counsel answered: “Someone who was registered to vote at the last general election.”
The discussion also distinguished territory transfers from changes in Educational Service Center (ESC) alignment, which require notice to boards of elections but are not territory transfers under the same statutory scheme.
The board’s action completes the State Board stage for this petition; local steps remain at the district level for final legal effect.
