Committee approves bill letting Secretary of State create UCC forms to fix broken links and bureaucratic inflexibility

Representative Jeff Ehlers presented House Bill 227 to the Senate Commerce and Human Resources Committee on March 3, 2025, asking the committee to allow the Secretary of State to adopt and maintain filing forms used under the Uniform Commercial Code (UCC) subject to UCC standards.
Ehlers told the committee the current statute lists the exact images of the forms in law, which forces a legislative change for even minor formatting adjustments. He said that online reproductions of the statutory forms can fail — “if you actually open up to, pull up the code 28.9.521 online, you will not find these forms, you will find broken JPEG links” — and that granting the Secretary of State authority to set forms consistent with UCC standards would fix administrative problems.
There were no public witnesses on the bill. A motion by Senator Nichols, seconded by Senator Ruckney, to send House Bill 227 to the Senate floor with a due-pass recommendation carried on voice vote. The committee recorded no roll-call vote.
If enacted, the bill would remove form images from statute and allow an administrative process to maintain forms so they remain usable and consistent with UCC requirements.
