Lyon County planning panel backs rezoning of 162-acre Dayton site to light industrial

The Lyon County Planning Commission voted unanimously March 11 to forward a recommendation to the Board of County Commissioners to rezone about 162.06 acres at 135 Evans Avenue in Dayton from rural residential (RR-20) to light industrial suburban (L1S).
The change, requested by BBCJ Investors LLC, aligns the parcel’s zoning with the countywide master plan land-use designation of “employment” in the suburban character district and with adjacent industrial properties to the north, staff said. The commission’s recommendation will go to the Board of County Commissioners for final action.
Lisa Lash, senior planner for Lyon County Community Development, told commissioners the parcel is outside the Lyon County Utilities service area but directly adjacent to land that currently is served. She said the applicant has initiated an annexation request with the utility district; if annexation is denied or capacity is unavailable, the property still could be developed using private wells and commercial septic systems.
Lash cited master plan policies the amendment supports, including Policy FS 1.1 on locating new development adjacent to existing utility systems, LU 1.4 on siting industrial uses consistent with the countywide plan, and LU 3.2 encouraging industrial development where public facilities exist or are planned. She said staff reviewed the site’s slope and surrounding Bureau of Land Management holdings and concluded light industrial suburban would be compatible with surrounding uses.
Chris Baker of Manher Consulting, speaking for the applicant, said no specific development is proposed at this stage and that the rezoning is intended to bring zoning into conformance with the adopted master-plan designation. Baker confirmed the applicant has begun the annexation process because the suburban character district typically requires public utilities for new development.
Commission discussion touched on mapping anomalies from the transition between Title 10 and Title 15 zoning nomenclature, and commissioners asked staff to clarify how the consistency matrix was applied. One commissioner said the presentation addressed advisory-board questions and that concerns about utilities could be resolved later in the project entitlement process.
The commission moved, seconded and voted to recommend approval; the transcript records the motion passing by a 7-0 tally. The county will now place the zoning map amendment before the Board of County Commissioners for final action.
What happens next: If the Board approves the zoning change, any future development proposals will require separate entitlements (for example conditional use permits or administrative design review) and, if necessary, a successful annexation into the Lyon County Utilities District or demonstration of alternative private utility service.
