Committee limits Captain’s Inn summer music waiver to 11 p.m.

The Lacey Township Committee on March 13 authorized a temporary relaxation of the township noise ordinance for waterfront restaurants that request it, limiting amplified outdoor music to 11 p.m. on permitted nights.

The request came from Captain’s Inn and surrounding waterfront restaurants, which historically have sought extended hours — in some years up to midnight — between Memorial Day and Labor Day. Committee members discussed prior experience: the township permitted later music in 2013 for a limited period, later reduced the hour after resident complaints, and subsequently settled on 11 p.m. for a number of years. Committee members expressed concern about noise echoing across the river and impacts on nearby condo and residential properties.

After discussion the committee moved and seconded a motion to permit music until 11 p.m. on the requested nights; the motion passed by voice vote. Committee members also noted prior conditions attached to such waivers, including orienting speakers toward land to reduce across-water echo, limiting content or volume to avoid offensive language, and requiring security patrols. One member suggested a temporary trial period and revisiting the policy if complaints re-emerged.

The decision applies to requests from waterfront restaurants that seek the committee’s permission; the township clerk will continue to require formal applications and any conditions the committee imposes when granting a waiver.
