The Peabody Conservation Commission continued to April 9 its consideration of a request for a full certificate of compliance for work at 18 Pearl Street (DEP file #55934), after staff and commissioners concluded portions of the approved project—most importantly a planned retaining wall—were not constructed and site runoff remains a concern.
Attorney Robert Peterson, representing the current homeowner Paul Barrasso, said the builder (DBIASI companies) had requested a continuance and that the parties are working to resolve outstanding items. Peterson said the new homeowner and the builder have been coordinating but that snow and recent runoff made on‑site conditions harder to evaluate.
Commissioners said the project as left appears out of compliance with the original order because the planned wall —shown on approved plans—was not built and the current site shows runoff that the wall was intended to mitigate. Staff recommended the commission continue the matter so the owner and builder can clarify whether the wall will be constructed or an alternative remedial plan will be proposed.
Vote details: the motion to continue consideration of the certificate of compliance to the April 9 meeting was made by Commissioner Arthur Athas and seconded by Commissioner Amanda Green; the continuation passed by roll call 5–0.
The commission also suggested that staff or members visit the site in spring if outstanding drainage conditions persist.
