The City of Tampa Variance Review Board on March 11 granted a rear‑setback variance for a rebuild at 2801 West Tyson Ave., allowing a corner of the proposed new home to encroach to 12.03 feet from the rear lot line where the zoning standard is 20 feet.
Staff said the lot has a sharply angled rear lot line; the applicant, Domain Homes, told the board the existing house was flood‑damaged and the new construction is required to meet current FEMA elevation standards. Fred Henry of Domain Homes explained the request is limited to the northwest corner of the proposed house and that natural resources, transportation and other reviewers found the plan consistent with conditions.
Henry said the hardship stems from the lot’s shape and that the proposed house was sited to preserve a nearby oak. Mark Major, the property owner, said the current home has flooded multiple times and he wants to return the lot to residential use.
Board members described the request as straightforward and said the applicant had accommodated the site constraints — including wider setbacks on one side and preservation of vegetation — before moving to grant the variance under section 27‑80.
